Your Blackwater Home Inspection includes but is not limited to structural components, mechanical systems and major kitchen appliances (please refer to your inspection agreement for details).

Once you’ve settled into your new home, Blackwater Home Inspections will continue to provide you peace of mind. Normal daily use of your property’s systems can lead to unexpected breakdowns or system failures. This is sometimes difficult to understand because you had a home inspection performed and items were found to be in serviceable condition. An inspection of any home component cannot guarantee it from potential failure.

This is why Blackwater Home Inspections will provide you with a 5 Star Guarantee which covers your property’s structure, plumbing, HVAC mechanical components, most major kitchen appliances, roof, water & sewer lateral pipes, new visible mold and termites. 90 DAY PROPERTY INSPECTION GUARANTEE  

PLUMBING, MECHANICAL AND ELECTRICAL COVERAGE SUMMARY: 1. Interior Plumbing to include water pipe leaks, drain/waste/vent  pipe leaks, gas pipe leaks and water heaters. 2. Central Heating to include the main property heating system only. 3. Central Cooling  to include the main property cooling system only. 4. Interior Electrical to include the main service panel, secondary service panel, wiring  and outlets. 5. Kitchen Appliances to include oven, range, cooktop, dishwasher and garbage disposal. 

STRUCTURAL COVERAGE SUMMARY: 1. Wall foundations to include poured concrete and block walls only. 2. Framing to include floor  framing systems, framed walls and partitions, beams, headers, girders and roof framing systems. 

COVERAGE TERMS: This Guarantee covers single family dwellings. This Guarantee covers only those systems listed in the coverage  summary that were inspected, operated and found to be in serviceable condition at time of the inspection and excludes all others. This  Guarantee offers coverage up to a maximum of $1,000 per system. This Guarantee covers parts and labor only and does not cover consequential or secondary damages. The client is responsible for a $100 deductible per system/incident. The client will be responsible  for payment of this $100 deductible or the actual service fee, whichever is lower to the service technician at the time of service. All  mechanical coverage is limited to those items within the properties foundation and is limited to an aggregate maximum of $1000.00.  All structural coverage is limited to issues within the properties foundation and is limited to an aggregate maximum of $1,000. The  client is responsible for arranging access to the property and the opening up of any surfaces needed to complete the repairs. We assume  no responsibility for the closing, resurfacing or decorating after the repair is completed. This Guarantee excludes coverage for all HVAC  (heating, venting, air conditioning) distribution ducts and/or piping. This Guarantee excludes central heating and cooling systems  over 10 years of age, water heaters over 5 years of age and kitchen appliances over 5 years of age. Auxiliary heating and/or cooling  appliances and/or window cooling units are excluded from coverage. Galvanized and/or lead piping and plumbing stoppages of any  kind are excluded from this Guarantee. Blackwater Home Inspections is not responsible for upgrading any failed or non-failed system in order to meet  current codes or local ordinances. The Structural portion of this Guarantee does not cover pest damage, including that caused by any  and all wood destroying insects and pests. The Guarantee provides coverage only for the client(s) who purchase a Blackwater Home Inspection and upon the transfer of the property deed to the client(s) which may or may not be within the (90) days of the inspection.  This Guarantee may not be transferred or assigned to any other party. All claims must be received within (90) days of the inspection date.   

CLAIMS PROCEDURES: 

  1. A written email notification of the claim must be received by Blackwater Home Inspections ([email protected]) prior to the expiration of the policy (which is defined as noon, the  91st day after the inspection is completed). The following information must be contained in the claim: Your name; Inspectors name; Property address; Contact Phone #; Email Address, Brief Description of the Claim, Make-Model-Serial # for Appliance  if applicable. 
  2. An itemized repair estimate must be submitted for every approved claim, including the breakdown of parts & labor as well as a specific  cause for the failure in writing from a licensed or properly certified specialist. The estimate must include contact information of the qualified or licensed specialist. Blackwater Home Inspections reserves the right to obtain up to two (2) additional estimates. 

Claims will be processed after we are in receipt of items 1 & 2. You will be contacted by Blackwater Home Inspections within 24 hours of all items being submitted unless over a weekend and/or holiday. 

1 YEAR ROOF LEAK GUARANTEE 

COVERAGE SUMMARY: Repair of leak(s) to your properties roof for a period of one (1) year following the date of the property inspection. 

COVERAGE TERMS: This Guarantee covers single family dwellings. This Guarantee covers the following residential roof materials with no  more than two layers installed: asphalt/composition shingles and single ply rubber membrane. Roof leak(s) repair shall be covered only  when the cause of the leak(s) is normal wear and tear. This Guarantee applies only to the main dwelling itself and specifically excludes  all other structures that may exist on the property. This Guarantee excludes coverage for roofs over 10 years of age. This Guarantee  does not cover roofs that were inspected and found to be leaking (past or present), were improperly installed, has worn materials and/ or other roofing defects at time of the property inspection. The Guarantee coverage is limited to $1,000 in aggregate. This Guarantee  covers materials and labor only and does not cover consequential or secondary damages. The client is responsible for a $150 deductible  per incident. The client will be responsible for payment of this $150 deductible or the actual service fee, whichever is lower to the service  technician at the time of service. Roof repairs completed under this Guarantee after the deductible has been met are guaranteed for  the remainder of the term of this Guarantee. This Guarantee does not cover repairs to material types that have been affected by a class  action lawsuit or manufacturer’s recall. This Guarantee does not cover repairs as a result of damage caused by you and/or third parties.  This Guarantee does not cover roof leaks that have been determined to be caused by ice damning, metal ridge vents, skylights, roof  protrusions, roof attachments of any kind and/or chimneys. On any claim, the client may request payment instead of payment to the  service provider and may be used towards a roof replacement. The Guarantee provides coverage only for the client(s) who purchase a  Blackwater Home Inspection. This Guarantee may not be transferred or assigned to any other party. All claims must be received  within one (1) year of the inspection date. . *This Guarantee is transferable to a buyer with a pre-listing property inspection that includes  inspecting the roof(s). 

CLAIMS PROCEDURES: 

  1. A written email notification of the claim must be received by Blackwater Home Inspections ([email protected]) prior to the expiration of the policy (which is defined as noon, the 366th day after the inspection is completed). The following information must be contained in the claim: Your name; Inspectors name; Property address; Contact Phone #; Email Address, Brief Description of the Claim, Make-Model-Serial # for Appliance  if applicable. 
  2. An itemized repair estimate must be submitted for every approved claim, including the breakdown of parts & labor as well as a specific  cause for the failure in writing from a licensed or properly certified specialist. The estimate must include contact information of the qualified or licensed specialist. Blackwater Home Inspections reserves the right to obtain up to two (2) additional estimates.

90 DAY WATER AND SEWER LATERAL GUARANTEE  

COVERAGE SUMMARY: 1. “Main Water Pipe”. The main water pipe is the single lateral water service pipe from the point of the water  utility’s connection to the point of the water meter or main shut off pipe inside the home. The water pipe also includes well water pipes,  excluding those exceeding five feet under the surface level of the yard. 2. “Main Sewer Pipe”. The sewer pipe is the single lateral sewer  service pipe from the point of the home’s exterior wall to the point of connection to the public sewer utility’s wastewater collection  system or private septic tank. 

COVERAGE TERMS: This Guarantee covers single family dwellings. This Guarantee covers only repairs for pipe breakages, collapses, or  significant leaks that affect the functionality of the property’s sewer and water systems and excludes all others. Any portion or component  of a system listed in the coverage summary must have been inspected, operated and been found to be in serviceable condition at time of  the inspection This Guarantee does not cover stoppages of any kind within drain, waste and/or sewer pipe(s). “Stoppage” without failure  of the pipe(s) is not considered a covered loss, the pipe(s) must be damaged. Guarantee coverage is limited to $1,000 in aggregate. This  Guarantee covers materials and labor only and does not cover consequential or secondary damages. The client is responsible for a $250  deductible per incident. The client will be responsible for payment of this $250 deductible or the actual service fee, whichever is lower to  the service technician at the time of service. We assume no responsibility of the closing, resurfacing or decorating after the water pipe  and/or sewer pipe repair has been completed. This Guarantee does not cover repairs to material types that have been affected by a class  action lawsuit or manufacturer’s recall. This Guarantee does not cover repairs as a result of damage caused by you and/or third parties.  The Guarantee provides coverage only for the client(s) who purchase a Blackwater Home Inspections sewer scope inspection. This Guarantee may not be  transferred or assigned to any other party. All claims must be received within (90) days of the inspection date. 

CLAIMS PROCEDURES: 

  1. A written email notification of the claim must be received by Blackwater Home Inspections ([email protected]) prior to the expiration of the policy (which is defined as noon, the 91st day after the inspection is completed). 90 DAY MOLD GUARANTEE

COVERAGE SUMMARY: New visible mold. If there were no visible mold or moisture issues reported during the course of your property  inspection and in your property inspection report, this Guarantee covers the remediation (removal) of visible mold on surfaces permanently  installed in the inspected property for a period of ninety (90) days from the date of the property inspection. 

COVERAGE TERMS: This Guarantee covers single family dwellings. This Guarantee covers only repairs as specified and excludes all  others. Guarantee coverage is limited to $1,000 in aggregate. Only new visible mold growth that occurs after the date of the property  inspection is covered. . This Guarantee covers materials and labor only and does not cover consequential or secondary damages. The  client is responsible for a $250 deductible per incident. The client will be responsible for payment of this $250 deductible or the actual  service fee, whichever is lower to the service technician at the time of service. Many surfaces can be treated and cleaned without removal.  The client is responsible for all costs associated with implementing any recommendations from the service provider to control conditions  conducive to mold growth. This Guarantee covers removal of those components which cannot be simply treated and cleaned. We assume  no responsibility of the closing, resurfacing or decorating after the mold treatment is completed. The Guarantee provides coverage only  for the client(s) who purchase a Blackwater Home Inspection. This Guarantee may not be transferred or assigned to any other party.  All claims must be received within (90) days of the inspection date.

90 DAY TERMITE GUARANTEE

COVERAGE SUMMARY: Treatment for Subterranean Termites (Reticulitermes sp., Heterotermes sp.) to the main structure for a period  of 90 days following the date of the wood destroying insect inspection. 

COVERAGE TERMS: This Guarantee covers single family dwellings that were inspected and were found to have no visible evidence of  subterranean termites inside the structure at time of the wood destroying insect inspection. This Guarantee does not cover termite  treatment to the structure when termites are found outside the structure foundation walls or anywhere else on the property in its entirety  to include wood piles, outbuildings, detached garages, carports, sheds, barns, decks, patios and fences. This Guarantee offers coverage  up to a maximum of $1,000 in aggregate. This Guarantee covers material and labor only and does not cover consequential or secondary  damages. The client is responsible for a $250 deductible. The client will be responsible for payment of this $250 deductible or the actual  service fee, whichever is lower to the service technician at the time of service. The client(s) is responsible for all costs associated with  implementing any recommendations from the service provider to control conditions conducive to termites. This Guarantee does not  cover any service programs and/or guarantees offered through the service provider. The client is responsible for arranging access to the  property and the opening up of any surfaces needed to complete any necessary termite treatment. We assume no responsibility for the  closing, resurfacing or decorating after the termite treatment is completed. This Guarantee does not cover termite treatment for changes,  alterations, remodeling, demolition or additions made to the structure after the date of the wood destroying insect inspection. This  Guarantee does not provide damage repairs against any old or new subterranean termite damage to the structure or its contents. The  Guarantee provides coverage only for the client(s) who purchase a Blackwater Home Inspections wood destroying insect inspection. This Guarantee may  not be transferred or assigned to any other party. All claims must be received within one 90 days of the inspection date. This Guarantee is not a termite maintenance contract nor does it cover any losses recoverable  under homeowners insurance, manufacturer and/or contractor warranties, termite service contracts or home warranty service contracts.  Properties with private well systems, cisterns, or springs located within the structures foundation walls and/or within 10 feet from the  exterior foundation walls are ineligible for coverage.  In no event will Blackwater Home Inspections assume any responsibility for termite treatment claims for any or all of the following reasons: Claims  reported after the expiration date of the Guarantee; on properties with outstanding invoices not paid in full for services rendered; where  termite treatment has been completed prior to formal notification; and on any termite related defects, disclosed or undisclosed, known  to either the buyer or seller before the transfer of the deed.

Disclaimer: Blackwater Home Inspections liability under these Guarantees will be terminated if we are prevented from fulfilling our responsibilities under  the terms of this agreement by reason of delays in transportation, shortage of fuel and/or materials, strikes, embargoes, fires, shifting  of land, frost heaves, floods, quarantine restrictions, earthquakes, tornados, high winds, hurricanes, war or any other act of God or  circumstances or causes beyond our control. This Guarantee is not a maintenance contract nor does it cover any losses recoverable under  homeowners insurance, manufacturer and/or contractor warranties, service contracts or home warranty service contracts. Multi-Family  dwellings and Commercial properties are ineligible for this Guarantee. This Guarantee does not cover remediation for any and all forms  of water intrusion. Blackwater Home Inspections assumes no liability for bodily injury caused by any of the inspected components or property damage  to others. We are not responsible for secondary damages or other conditions resulting from the malfunction or misuse of the systems  in the property. We disclaim any liability for the adequacy of a system or the design of a system or its failure to comply with any local,  state or national code. In no event will Blackwater Home Inspections assume any responsibility for repair claims for any or all of the following reasons:  Claims reported after the expiration date of the Guarantee; on properties with outstanding invoices not paid in full for services rendered;  where repair work has been completed prior to formal notification; and on any defects, disclosed or undisclosed, known to either the  buyer or seller before the transfer of the deed.  

Small Claims Court: The client and Blackwater Home Inspections agree that any controversy or claim between them arising out of or relating to this  Guarantee shall be settled in the state of Maryland, Delaware or Pennsylvania by Small Claims Court. The decision of the magistrate  judge shall be a final and binding resolution of the disagreement which may be entered as a judgement by any court of competent  jurisdiction. Neither party shall sue the other where the basis of the suit is this Guarantee other than for enforcement of the magistrate’s  decision. In no event shall either party be liable to the other for indirect, special, or consequential damages or loss of anticipated profits. 

Notice of Claims & Access to Property: Any claim under this Guarantee must be made to us during the Guarantee term. We are only  obligated to make repairs under this Guarantee if a valid claim is made during the Guarantee term and client must allow us access to  the identified property for any purpose contemplated by this Guarantee. Any repairs made prior to notification and authorization by  Blackwater Home Inspections will void this Guarantee with respect to the system so repaired. Prior to any repair work, the client must notify the Blackwater Home Inspections office that performed the inspection in writing during the term of this Guarantee. We will advise the client on the proper  repair procedures.
